Ordering process

The ordering process is as follows: after selecting the product you want to purchase; you choose the payment manner and execute the payment and confirm the order. Before paying, you have the possibility to go back in the process (clicking the “back” button) if you see that a mistake has been made and you would like to modify it. You must ensure that the information you submit in your order is accurate and complete before paying, because afterwards it is impossible to bring any modification because on most days the delivery starts immediately. Should it not be the case, modifications will be allowed in so far it has been agreed by Crystal Shea Kenya in writing.

When you place an order, you make an offer to us to buy a product. After you have placed an order, we will send you an e-mail and/or a message confirming your order. This confirmation means that a binding agreement will exist between us, except if there is an inability to process orders, which you shall be informed at least within two working days after placing your order. Crystal Shea Kenya maintains records of orders and allow you to have access to it for an indefinite period.

Crystal Shea Kenya recommends that you keep a printed copy of these terms and conditions as well as a copy of the order confirmation and invoice.

Price – Payment

The price calculated by Crystal Shea Kenya contains the cost for the products rendered by Crystal Shea Kenya, the manufacturing of the product and the delivery/shipment of the product, as well as taxes when applicable. There is no insurance. Other duties and taxes applicable for the delivery of the product, even if not mentioned in the invoice sent by Crystal Shea Kenya, will be paid by you. The price is calculated in Kenyan Shillings and accepts Mpesa, AirtelMoney and Bank Card payments. Offsetting against any kind of non-approved counter-claims as well as execution of right of retention of goods shall be excluded unless established in court, undisputed or recognized by Crystal Shea Kenya. Crystal Shea Kenya remains the sole owner of the products until their entire payment, transport and taxes included have been paid.

Term of delivery

The actual delivery time is determined by a number of circumstances, for example (but not limited to) working conditions applicable at the time the agreement is concluded, on the punctual delivery of the natural skincare products ordered for the execution of the order.  Should your payment details be incorrect, the delivery will be postponed until the correct information is received from you.

Crystal Shea Kenya uses its discretion, unless specifically instructed by you, in selecting a reputable carrier and appropriate means of delivery. All risks during transport are borne by you.

Communication

Internet communications are capable of data corruption and therefore Crystal Shea Kenya does not accept any responsibility for alterations made to such communications after their dispatch. It may therefore be inappropriate to rely on information/advise contained in an email without obtaining written confirmation of it. Crystal Shea Kenya does not accept responsibility for any errors or problems that may arise through the use of Internet communication and all risks connected with sending commercially sensitive information relating to your business are borne by you. If you do not agree to accept this risk, you should notify Crystal Shea Kenya in writing that e-mail is not an acceptable means of communication.

Prices are stated in in Kenyan Shillings and payment may be made via M-Pesa, AirtelMoney or Bank Card. Please note that insurance is not included. Other additional duties and taxes applicable for the delivery of the product, even if not mentioned in the invoice sent by Crystal Shea Kenya, will be borne solely by the customer. Offsetting against any kind of non-approved counterclaims as well as execution of right of retention of goods shall be excluded unless established in court, undisputed or recognized by Crystal Shea Kenya in writing. Crystal Shea Kenya remains the sole owner of the products until their entire payment, transport and taxes included have been paid.  

Delivery  Terms

The estimated delivery time depends on various factors, including, (but not limited to) prevailing working conditions at the time of order confirmation and on the timely availability of the natural skincare products required to fulfill your order. Should your payment details be incorrect, the delivery will be delayed until the correct information is received and payment confirmed.  

Crystal Shea Kenya uses its discretion, unless specifically instructed by you, in selecting a reputable carrier and appropriate means of delivery. All risks associated with the transportation of the products, including loss or damage during transit, shall pass to you upon dispatch. It is strongly recommended that customers arrange appropriate insurance if required.

Returns, Refunds and Cancellations

Due to the nature of our products, returns are not accepted once items are opened or used. Refunds are only available for damaged, defective, or incorrectly delivered products, subject to written request within 3 days of delivery. Crystal Shea Kenya reserves the right to accept or reject such requests.

Electronic communications, including email and other internet- based communications are subject to risks such as data corruption, interception, unauthorized modification, or delay and therefore Crystal Shea Kenya does not accept any responsibility for alterations made to such communications after their dispatch nor for any errors, missions, or issues that may arise due to the use of internet communication. Governing Law, Jurisdiction  

The sale of products and these terms shall be governed by and construed under the laws of Kenya. Any dispute arising out of or in connection with the sale or use of Crystal Shea Kenya Products shall be governed by and construed in accordance with the laws of the Republic of Kenya. Before initiating court proceedings, the parties agree to first attempt to resolve the matter through mediation in good faith. If mediation fails, the dispute may be referred to the courts of competent jurisdiction under Kenyan Law.

Warranty

Crystal Shea Kenya warrants that its natural skincare products shall substantially conform to the description of the ordered item. Crystal Shea Kenya reserves the right to determine the packaging orientation of the ordered products. A product may not be returned or refused solely due to the packaging format. 

CRYSTAL SHEA KENYA MAKES NO WARRANTY OTHER THAN THOSE MADE EXPRESSLY IN THIS TERMS AND CONDITIONS TO THE FULLEST EXTENT PERMITTED BY

LAW. CRYSTAL SHEA KENYA HEREBY EXPRESSLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.  

No waiver

Force Majeure

Crystal Shea Kenya will make every effort to perform its obligations under these terms. However, Crystal Shea Kenya is not liable in case of force majeure. Force majeure implies any circumstance beyond the control of Crystal Shea Kenya – even if this circumstance was foreseeable at the time the agreement was concluded – which permanently or temporarily prevents fulfilment of the agreement, including in particular transport failure, strikes, terrorist acts, war, supplier/transport issues, governmental or regulatory action and natural disasters. In the event of a delay, Crystal Shea Kenya will perform our obligations as soon as reasonably possible.

Severability  

If all or any part of one or more of these terms is or becomes illegal, invalid, unenforceable, or prohibited in any respect under any applicable law or regulation or found to be illegal or unenforceable in whole or in part under any applicable Kenyan law, or regulation of any jurisdiction or country, or with respect to a certain category of persons, such provision or part shall to that extent, be deemed not to form part of the contract.  The legality, validity or enforceability of the remainder of these terms or the remaining parts of the relevant term shall not in any way be affected or impaired thereby (in relation to such jurisdiction or country, or category of persons). The legality, validity or enforceability of such provision under the applicable laws of any other jurisdiction or country or category of persons, shall not in any way be affected or impaired.
